1. The following is a legal Agreement between you (the "Licensee") and Topmodel.Info. ("Licensor"). The Licensee accepts this Agreement by paying for and downloading and using any Open Licence Images.


2. Permitted use

By this Agreement the Licensor grants the Licensee the non-exclusive, non-transferable right to:
2.1 Back up, copy, archive the Image(s) as necessary for their use.
2.2 Alter, crop, manipulate and create derivative works of the Image(s) as necessary for their use.
2.3 Use the Image(s) as part of advertisements, brochures, reports, newsletters, packaging and items that incorporate the Image(s) in books design, clothing, calendars and CD packaging.
2.4 Use the Image(s) for the projects created for Licensee's employers, or direct clients or customers, who must be the end-users of the Licensee's work.
2.5 Any other uses of the Image(s) must be approved in writing by Licensor.


3. Restrictions

This Agreement does not permit Licensee to:

3.1 Loan, rent, sell, sublicense, convey or otherwise transfer the right to use the Image(s) to any third party for any purpose, except as specially provided in this agreement. The Licensee may sell or license derivative works in accordance with the Acceptable Use Policy. Images may not be distributed or sold individually in such a way that the Image(s) can be extracted or accessed as a stand-alone file.
3.2 Use of the Image(s) in a pornographic, defamatory, libellous or otherwise illegal manner, whether directly or in context with other material is strictly forbidden.
3.3 Use or reproduction of the Image(s) in any way, except as outlined in this Agreement, is not permitted.
3.4 Use of the Image(s) or any part of it(them) as part of a trademark or logo is not permitted. The Licensor keeps full rights to the Image(s), so the Licensee cannot establish his own rights to any part of the images.
3.5 Distribute any Image(s) via computer or any other form of online or Internet-
accessible service.
3.6 Post the Image(s) online in a downloadable format is not permitted.
3.7 Display the Image(s) in any digital format or for any digital use at a resolution greater than 640x480 pixels, except in editorial or preliminary design work. Doing so will be viewed as an attempt to distribute the Image(s).


4. Warranties

4.1 Licensor does not warrant that the Image(s) will meet Licensee requirements. The whole risk as to quality or performance of the Image(s) lies entirely with the Licensee. Only the Licensee (not the Licensor) assumes the entire costs of harms effected to or by the image concerned.
4.2 The Licensor will not be liable for any general, special, direct, indirect, consequential or incidental damages or lost profits or any other damages, costs or losses resulting from the use of the Image(s) or the inability to use them.


5. Termination

The Licensor has the right to terminate the present agreement at any time by e-mail or regular mail notice to the latest known address of the Licensee, if the Licensee fails to comply with the terms of this Agreement. In this case the Licensee must immediately
1) stop using the Image(s),
2) destroy all copies and archives of the Image(s).


6. Entire contract

6.1 The explanations to any FAQ's and other explanations as well as the content of Topmodel.info's website are for customer's information only and shall not be considered as part of this Agreement.
